Human Resources
Personnel
In 2015 it remains mandatory to enter data from sick leave certificates in the BORA BS register. The register generates the file with information for Annexes 15 to the sick leave certificates. For all sick leave certificates issued after 31.12.2014 the series is entered in Latin letters.

New in entering compensation under Article 222(1) of the Labour Code
- The compensation is now entered on one line with code 252 in the pay slip for the month in which it will be paid.
- The amount entered under the code is the total amount of the compensation.
- The dates entered under the code are the first day of insurance on the relevant ground and the last day of insurance (as insured person type 27).
- When the payment date is entered, BORA BS allows a payment date for insured person type 27 that differs from the other records for the month.
More information on compensation under Article 222(1) of the Labour Code (for unemployment)
Compensation under Article 222(1) of the Labour Code is paid when the employer terminates the employment contract of a worker or employee who is left without work or who, after dismissal, has started a job with lower pay. The employer’s obligation to pay compensation on this ground arises when the employer has terminated the contract because of the closure of the enterprise or part of it, staff cuts, a reduction in the volume of work, or a stoppage of work for more than 15 working days.
The employer owes the compensation when the person’s employment was terminated on any of the following grounds: Article 328(1)(1); Article 328(1)(2); Article 328(1)(3); Article 328(1)(4); Article 328(1)(7), Article 328(1)(8).
The compensation equals the worker’s or employee’s gross pay for the time they remained without work, but for no more than 1 month. An act of the Council of Ministers, a collective labour agreement or the employment contract may provide for compensation for a longer period. If during this period the worker or employee starts a job with lower pay, they are entitled to the difference for the same period.
The compensation is not paid on the date the employment contract ends; at that point the employee is not yet entitled to it. It is not stated as due in the dismissal order, as is the case under Article 224 of the Labour Code, for example. At least 30 calendar days after the employment relationship ends, the employee may go to the former employer to receive the compensation. It is important to know that the compensation is paid at the employee’s request, and the employer is not obliged to look for the employee to pay it. The right to receive the compensation lapses after 3 years, i.e. if 3 years have passed since the date the employment relationship ended, the employee loses the right to compensation. The employee provides the employment record book and a free-text declaration stating the period during which they were without work. If they started work elsewhere immediately after the contract ended, they are not entitled to this compensation. If they have not started work, they are entitled to the full amount of the compensation, i.e. one month’s gross pay. If they were without work for, say, 15 days, they are entitled to an amount proportional to the working days of the period without work. If they started work but with lower pay, they are entitled to a one-off payment of the difference between their current and previous pay.
In Declaration No. 1 the compensation is declared with the period it relates to, regardless of when it was paid. This period counts towards insurance service but not towards length of service. Contributions to the Pensions fund, supplementary compulsory pension insurance and personal income tax are due on the amount of the compensation. The employee must pay their own health insurance for the period.
It is important to know that the data for Declaration 1 is regular data, not a correction. If the compensation relates to a period covering two months, two Declarations No. 1 are submitted for the person, showing the day from which insurance began or resumed and the last day of insurance respectively.
Declaration No. 6 is submitted as a supplement for the months it relates to, with payment code 6. In item 18, Payment date, the date of the last calendar day of the month in which the unemployment compensation was paid is stated.
The deadline for paying the contributions is the 25th of the month following the month in which the unemployment compensation was paid. Declarations No. 1 and No. 6 must be submitted within the same deadlines.
Payrolls
What’s new in preparing Declarations No. 1 and No. 6 in 2015
The following have changed:
- The specification of the input files for capturing data from Declaration No. 1 “Data on the insured person”, valid for submitting data from 01.01.2015.
- How item 18, Payment date, is filled in on Declaration No. 6
- When code 4 is entered in item 8, for pay under contracts without an employment relationship paid after 31 December 2014, the date of the last calendar day of the month in which the pay was paid is entered.
- When code 6 is entered in item 8, for the contributions due for persons for whom the time under Article 9(3)(1) and (2) of the Social Security Code counts as insurance service, the date on which the act took effect is stated.
- When code 6 is entered in item 8, for the contributions due for persons for whom the time under Article 9(3)(5) of the Social Security Code counts as insurance service, the date of the last calendar day of the month in which the unemployment compensation was paid is stated.
In the new feature NRA, NSSI: Declarations 2015, preparing the declarations goes through the following mandatory steps:
Entering the payment date:

The payment date determines the deadlines for paying the contributions and income tax.
The payment date entered under Links is propagated to the records of everyone with pay slips in the selected month. It may be changed and differ only if the insured person type is 14 or 27.
- Preparing Declarations No. 1 and No. 6
For the process to complete successfully:
- The employer’s contributions must have been calculated.
- The payment date must be filled in.
- The process must not have been run already.
If data for Declarations No. 1 and No. 6 has already been generated, it can be generated again after the process is undone:

The data for both declarations is prepared at the same time when the month is chosen in the filter.

The tick columns No. 1 Declaration and No. 6 Declaration show whether the row will be included in the file for Declaration No. 1 and in the amount calculations in Declaration No. 6. The ticks are set by the system depending on the payment date and the date derived from it, For declaration, in other words the due date.
With a tick in the For export column, the user can exclude any record from the declarations.
The Links button shows a report of the calculated data for Declaration No. 6.
